Terms and Conditions
1. Interpretation
1.1 In these Terms:
* Company: means RK Lifestyle (ABN 34 217 240 255).
* Customer: means the purchaser of Goods from the Company.
* Goods: means all custom-made or laser-engraved products sold and/or delivered by the
Company to the Customer.
* Terms: means these terms and conditions of sale.
2. Application
2.1 These Terms apply to all contracts for the sale of Goods by RK Lifestyle.
2.2 No amendment, alteration, waiver, or cancellation of any of these Terms is binding on RK
Lifestyle unless confirmed by RK Lifestyle in writing.
2.3 The Customer acknowledges that no employee or agent of RK Lifestyle has any right to
make any representation, warranty, or promise in relation to the Goods or the sale of the Goods
other than as contained in these Terms.
3. Prices
3.1 Prices are determined at the time of order and, prior to payment of the deposit, are subject
to change without notice.
4. Payment
4.1 Payments are to be made to RK Lifestyle without any deduction or discount other than as
stated in these Terms or in the relevant invoice or statement.
4.2 Where Goods are ordered with a custom design or material selected by the Customer, full
payment for the design and/or material may be required upfront at the time the deposit is paid.
4.3 The balance of the invoice price must be paid in full before delivery or commencement of any custom design work (whichever is earlier).
4.4 Interest is payable on all overdue accounts calculated on a daily basis at the rate of 1.5%per month as from the date due for payment until payment is received by RK Lifestyle.
5. Delivery
5.1 The Customer must, within 5 days of being notified of their availability, collect or accept
delivery of the Goods and pay the balance of the invoice price (if applicable).
5.2 If the Customer fails to collect the Goods or accept delivery within 5 days of being notified
of their availability, RK Lifestyle may terminate this contract, keep the deposit, and resell the
Goods.
5.3 In addition to clause 4.4, RK Lifestyle reserves the right to charge the Customer storage on
goods not collected or delivered within 5 days of notification of their availability at the rate of
$15 per week or part thereof.
5.4 RK Lifestyle reserves the right to deliver the Goods in whole or in instalments, as well as to
deliver prior to the estimated date for delivery. In such an event, the Customer must not refuse
to take delivery of the Goods.
5.5 Any failure on the part of RK Lifestyle to deliver instalments within any estimated timeframe
does not entitle the Customer to repudiate the contract with regard to the balance remaining
undelivered.
6. Title
6.1 Legal and beneficial ownership of the Goods will not pass to the Customer until such time
as the Goods have been paid in full in cash or cleared funds.
7. Risk and Insurance
7.1 The Goods are entirely at the risk of the Customer from the moment of delivery to the
Customer’s point of delivery or on collection, even though title in the Goods has not passed to
the Customer at that time.
7.2 The Customer must, at its own expense, insure the Goods for their full replacement value
for the benefit of RK Lifestyle against theft, damage, fire, and other risks as from the moment of
delivery to the Customer and until title in the Goods has passed to the Customer.
8. Inspection
8.1 Unless the Customer has inspected the Goods and given written notice to RK Lifestyle
within 2 days after collection or delivery that the Goods do not comply with the agreed-upon
design or specifications, the Goods are deemed to have been accepted in good order and
condition.
9. Cancellations
9.1 No order may be cancelled, modified, or deferred without the prior written consent of RK
Lifestyle (which is at RK Lifestyle’s sole discretion). If such consent is given, it is subject to RK
Lifestyle being reimbursed for all reasonable costs incurred up to that point, including design
work, material procurement, and a cancellation fee (being not less than 25% of the invoice
price of the Goods).
10. Limited Liability
10.1 Australian Consumer Law (ACL): These Terms and Conditions do not affect the rights and
remedies you have under the Australian Consumer Law (ACL) which cannot be excluded by
agreement.
10.2 Warranties and Liability: RK Lifestyle acknowledges its obligations under the ACL to
supply Goods of acceptable quality, fit for any disclosed purpose, and free from defects. We
will, at our option, repair, replace, or refund faulty or defective Goods within a reasonable
timeframe.
10.3 Exclusions and Limitations: We exclude liability for any loss or damage you suffer that is
not reasonably foreseeable arising from our supply of the Goods or these Terms and
Conditions. This includes, but is not limited to, consequential loss, loss of profits, business
interruption, or damage to other property.
Our liability for any breach of a guarantee under the ACL is limited to the remedies set out in
clause 10.2 (repair, replacement, or refund).
10.4 Disclaimers: RK Lifestyle does not warrant that:
● The Goods will be compatible with all equipment or software you intend to use them
with.
● The Goods will meet your specific needs or expectations.
● The Goods are completely error-free.
11. Warranties
11.1 Manufacturer Warranties: All Goods supplied by RK Lifestyle may also be covered by
separate warranties provided by the manufacturer. Please refer to the manufacturer’s warranty
information for details on coverage, duration, and claim procedures.
11.2 Defect Notification: In case of a defect with the Goods, you must notify RK Lifestyle in
writing within 2 days of discovering the defect. Please describe the nature of the defect in
detail. Do not attempt to repair the Goods yourself without prior written consent from RK
Lifestyle, as this may void your warranty.
11.3 Consumer Guarantees: The ACL provides certain consumer guarantees that cannot be
excluded by these Terms and Conditions. These guarantees include that the Goods must be of
acceptable quality, fit for any disclosed purpose, and free from defects.
12. Samples and Displays
12.1 Display and Sample Disclaimer: Any display products or samples you see are for
illustrative purposes only and do not constitute a sale by sample.
13. Entire Agreement
13.1 These Terms and Conditions, together with any other written agreements between you
and RK Lifestyle, constitute the entire agreement between us regarding the sale of Goods.
14. Governing Law and Jurisdiction
14.1 These Terms and Conditions and any contract for the sale of Goods by RK Lifestyle are
governed by the laws of Western Australia, Australia. In the event of any dispute arising from
these Terms and Conditions, the exclusive forum for such dispute will be the courts located in
Western Australia.
15. Right to Enter Premises
15.1 In exceptional circumstances, and only with the prior written consent of the owner of the
premises, RK Lifestyle may be required to enter the premises where the Goods are located to:
● Collect the Goods if the Customer has failed to collect them within a reasonable
timeframe after notification.
● Retrieve faulty Goods for assessment and repair or replacement under warranty.
15.2 RK Lifestyle will use all reasonable efforts to minimize disruption to the owner’s premises
and will only enter during mutually agreed-upon times.
16. Force Majeure
16.1 RK Lifestyle will not be liable for any delay or failure to perform its obligations under these
Terms and Conditions due to circumstances beyond its reasonable control, including but not
limited to: acts of God, natural disasters, strikes, lockouts, wars, riots, civil commotions,
government intervention, fires, floods, earthquakes, explosions, or transport disruptions.
17. Waiver
17.1 Our failure to enforce any provision of these Terms and Conditions on one occasion does
not waive our right to enforce it on any other occasion.
18. No Assignment
18.1 You may not assign your rights or obligations under these Terms and Conditions without
the prior written consent of RK Lifestyle.
19. Severability
19.1 If any provision of these Terms and Conditions is held to be invalid or unenforceable, such
provision shall be struck out and the remaining provisions shall remain in full force and effect.
